Recently, the Province of British Columbia has implemented new short-term rental regulations to address the housing shortage that took effect on May 1, 2024. 

Since the law has gone into effect, here’s what you need to know:

Key Points:

  • Principal-Residence Requirement: Short-term rentals must be in the operator’s principal residence, a secondary suite, or a laneway home.
  • Exemptions: Certain properties can be exempt from these requirements.

Exemption Criteria:

There are two main exemption categories that most properties will fall under:

Existing Strata Hotels and Motels:

  • Must provide hotel/motel-like accommodation.
  • Must have:
    • Staffed front desk on site.
    • Housekeeping services for overnight accommodations.
    • A dedicated web platform for short-term rentals.

New Strata Hotels and Motels:

  • Must meet all the above service requirements and legal-use restrictions.

OR

At least one strata lot must be unusable as a principal residence due to:

  • Zoning restrictions.
  • A rental management agreement.
  • A restrictive covenant or covenant under section 219 of the Land Title Act.

However, there are some new exemptions that have been outlined by the government:

Accessory dwelling unit 

  • A self-contained living unit with its own kitchen, sleeping area, and washroom facilities, and which is located on the same property as a dwelling unit.
  • Can be a garden suite, laneway home, carriage house or garage suite. 

Fractional ownership 

  • Fractional ownership refers to a situation where a host owns a part or fraction of a property with the right to use it for an equal fraction of the year. 
  • The owner is restricted from using the property as their principal residence because of rules outlined in the fractional ownership agreement.  

​Home exchange or house swapping

  • A home exchange is an arrangement where a person offers a right to use the person’s property for accommodation in B.C. in exchange for the right to use another person’s property.

Outdoor Recreational Activity 

  • Outdoor recreational activities, as defined in section 8 (2) of the Prescribed Classes of Property Regulation, are certain activities that are typically connected to lodges. 
  • These activities are either organized by or through the operator of the overnight commercial accommodation, or are carried out with a guide: 

Community-Specific Updates:

  • Parksville:
    • Approximately 400 properties along Resort Drive are exempt.
    • Exemption based on municipal tourism zoning and covenants in place.
    • Exemption ensures continued operation of tourism accommodations, preventing economic impact.
  • Predator Ridge in Vernon:
    • Also received an exemption due to zoning for short-term rentals.

Impact on Property Owners and Renters:

  • Property Owners: Ensure your property meets exemption criteria or adjust to the new regulations.
  • Renters and Visitors: Expect more properties to shift from short-term rentals to long-term housing, but certain areas will still offer tourist accommodations.

Q: How will these changes impact tourism?

Key tourist areas like Parksville and Predator Ridge have received exemptions to maintain tourism accommodation availability. However there are many areas that will be heavily impacted by this legislation and will undoubtedly have an adverse affect on tourism. How severe the impact will be and how communities will cope with the changes are yet to be seen. 

Q: What if I booked a vacation rental before May 1st? Will my booking be honoured?

If you have booked a short term rental before May 1st it is up to the host and platform that you booked with to ensure that your booking follows the new guidelines. Guests will not face fines for staying in a short term rental that does not comply with the rules because the responsibility lies with the host and platform. While many operators are already operating in compliance with the new laws, you might want to do due diligence and ask what the legal status of the property is to ensure you don’t run into any issues.

Breakdown of B.C.’s Short-Term Rental Accommodations Act 

Housing Minister Ravi Kahlon and Premier David Eby introduced B.C.’s short-term legislation in order to address British Columbia’s housing crisis which–according to the BC government–has been exacerbated by the widespread use of entire homes for short-term rentals. According to the information provided, there are 16,000 homes across BC that are used for short-term rentals rather than long-term rentals creating scarcity for appropriate long-term rentals for residents. To counter this, the Short-Term Rental Accommodations Act has been introduced with the following key points:

Purpose of the Act:

  • Empower local governments with tools to enforce short-term rental bylaws.
  • Reintegrate short-term rental units into the long-term housing market.
  • Establish a new Provincial role in short-term rental regulation.

Applicability:

  • Covers short-term rentals offered to the public via various platforms and listing forums.
  • Does not apply to certain categories like reserve lands, hotels, or temporary shelters.

Enforcement Measures:

  • Local government fines for bylaw offences have increased significantly.
  • Regional districts now have business licensing authority for short-term rentals.
  • Display of a valid business licence number on listings is mandatory as of May 1, 2024.
  • Short-term rental platforms must remove listings without a valid business licence.

Data Sharing:

  • Short-term rental platforms are expected to share information about listings with the Province by summer 2024.
  • The Province will maintain confidentiality but use the data for bylaw enforcement.

Returning Units to Long-Term Market:

  • As of May 1, 2024, short-term rentals are limited to the host’s principal residence plus one secondary unit.
  • Protections for non-conforming use of property will no longer apply to short-term rentals.

Provincial Oversight:

Late 2024 or Early 2025:

Anticipated launch of the provincial short-term rental registry.

While these dates highlight key milestones in the implementation and enforcement of BC’s new short-term rental regulations, readers should stay vigilant for any updates or changes to the timeline from official government sources.

What Short Term Rentals Will Be Allowed?

According to the new legislation, as of May 1, 2024, the Province will limit short-term rentals to the host’s principal residence plus one secondary suite or accessory dwelling. This means that if you have a basement or attic suite or a laneway home on the property of your principal residence, you are able to use those spaces as short-term vacation rentals.

Remaining Issues and Unanswered Questions

Approaching the May 1, 2024 deadline, property owners stand at a crucial juncture, striving to comply with imminent regulations while grappling with uncertainties surrounding enforcement timelines. 

Opting In and Out

Adding to the complexity, municipalities can “opt out”, or seek special exemptions from the Act until February 29, 2024. Regions not initially covered by the Act can “opt in” by March 31, 2024, which only intensifies the complexity of this situation. It is interesting that the “op-in” timeline is far longer than the “opt-out” timeline – another question yet to be answered.

Minimum Stay Requirements 

A contentious point emerges from the redefinition of long-term rentals, shifting from a 30-day minimum stay to a now-required 90-day minimum in opted-in zones, impacting the mid-term stay market.

Amidst the confusion, concerns about potential class-action lawsuits against the BC Government loom large, particularly regarding Legal Non-Conforming properties initially zoned and built for short-term rentals. These properties face unique challenges as zoning changes come into play.

Upcoming Election

Further complicating matters, the 2024 election introduces political uncertainty. Opposition parties have diverse stances, ranging from promises to modify or repeal the Act to advocating for a more robust take on controlling short-term rentals.

Future Bookings

One of the main questions that guests are asking is: if I’ve made a booking before May 1st, 2024 for any time after that date (ex. June, July, August or later) will the booking still be honoured? The short answer is yes, even if your booking is in a captured area where the restrictions are in place, as long as the booking was made before May 1st, you can expect that the booking will still be valid. After May 1st, 2024 vacation home owners are to cease accepting bookings that are less than 90 days in length. 

Given the expected completion of the mandatory provincial short-term rental registry by the end of 2024, a crucial question persists: How can property owners navigate this intricate web of short-term rental rules, potential legal challenges, and political uncertainties, especially in places like Victoria? COVID-19 Update EMR Vacation Rentals

As of April 1, 2022, Canada now allowing all travelers from the United States, who have been fully vaccinated to cross into Canada without having to take a COVID-19 test. There is still a requirement to use the ArriveCan travel app to upload proof documentation and crossing times.

April 8, 2022 the BC Government has lifted the requirement for a \”proof of vaccination\” to access most public businesses and facilities. There may be some businesses that choose to continue to operate requesting proof. We just ask you to respect their wishes. Important Updated Notice as of April 23, 2021 for Guests Staying between April 20 – May 24, 2021

For guests already staying in the properties at the time of this release are not required to leave under this order. If you are staying in any of our properties for essential reasons during this time frame we are still open to host your stay.

For guests with stays booked during this date range for non essential reasons EMR Vacation Rentals will now accept cancellations for stays the begin April 20 and ending on May 24, 2021 using the COVID-19 Cancellation Clause in our guest agreement.

Section 2.4 of the Guest Agreement

2.4 Special Cancellation terms for the Guest booking during COVID-19 pandemic

2.4.1 The Guest agrees that if booking after March 18, 2020 during the COVID-19 pandemic that they are sharing in the risk and understanding that there is the possibility local or international authorities may prevent the Owner and the Owner’s Agent to be able to provide access to the property.

2.4.2 In the event the Owner and the Owner’s Agent are unable to provide access to the property for the Guest due to forced closure of travel directly where the property is located by official local government authorities, or by the Province of British Columbia, or the Government of Canada, the following will apply. The Owner and the Owner’s Agent will do their best to move the Guest’s booking to a future date in the same property, or provide payments received from the Guest as a credit toward a future date to be used by the Guest within 12 months, or provide a refund less 25% of the total cost of accommodation (base rent plus applicable taxes and fees)

Here are the options that we are making available to our guests directly impacted by these orders at this time.

  1. We will continue to be open and can host your stay. Must ensure you are following all provincial health orders when staying at the property.
  2. Attempt to move your dates in the same property for a future date (if available or to different property if dates are not available for the original property booked). 
  3. Convert your deposits paid into a non refundable stay credit to be applied to a future stay to be used within 12 months of cancellation. 
  4. Cancel your booking completely receive a refund less 25% of the total booking value as a cancellation fee.

At this time, all non-essential travel should be avoided. This includes travel into and out of B.C. and between regions of the province. For example:

  • Do not travel for a vacation
  • Do not travel to visit friends or family outside of your household or core bubble

Stays within Vacation Rentals
The Provincial Health Doctor, Dr. Bonnie Henry, has made a temporary Health Order in council with regard to use of vacation rentals and private residences. The requirement is in effect until May 24, 2021 and overrides earlier health orders from the Province of BC.

2. There is an advisory to travel only for essential purposes but there is no official restrictions at this time for travel.

3. Mandatory Mask Mandate is in place in all public buildings and private businesses throughout British Columbia.

4. No gatherings or events.

IMPORTANT NOTICE JULY 27, 2020:
The Provincial Health Doctor, Dr. Bonnie Henry, has made a Health Order in council with regard to use of vacation rentals.

Please note the following orders;

  1. A maximum of five individuals may attend a social gathering or an event in vacation accommodation, in addition to the occupants;
  2. The owner of vacation accommodation must require any tenant, guest or other person using the vacation accommodation to comply with the requirement in section 1.

EMR Vacation Rentals already has a requirement that all guests fill in a roster of all guests that will be staying at the property.

If you are planning to have non staying guests (visitors) over to the vacation rental property you are renting, it is a requirement that you provide EMR Vacation Rentals with a list of names and their contact information for each additional visitor. We need this list in the event a requirement from the Province of BC to contract trace all guests and visitors to the rental.

As British Columbia begins opening up after successfully flattening the COVID-19 curve and having one of the lowest infection rates in North America, we believe staying in a vacation rental will be the best option for travel this year throughout the Summer, Fall, and Winter 2020-2021.

Precautionary Measures EMR Vacation Rentals is Currently Taking

We have always used cleaning products with disinfectant. In addition to normal cleaning procedures, our housekeeping staff will increase focus on “high touch” items like light switches, doorknobs, remotes, etc. We are also removing non essential decorative pillows, blankets, and comforters.

EMR has adjusted check-in and check-out times to provide extra cleaning time. We are now asking guests to depart no later than 10 AM and check-in not earlier than 5:00 pm. We have also, where possible, placing 24 hour blocks from rentals between rental dates in 2020. We do have rentals that have been pre-booked with back to back rental dates. We are unable to accommodate later check out or early check-ins on back to back changeover days. Please contact our guest services team to confirm if early arrivals can be accommodated.

No Contact Check-In. Check-in for all properties is available via Greeter that will provide a social distancing check-in procedure, Electronic lock, or Lock box access. Our guests services team will be providing each guest with instructions dependent on which property they have booked and time of arrival.

Note: EMR Vacation Rentals reserves the right to change these temporary policies at any time.

Are you providing refunds on cancelled bookings?

We are no longer providing refunds, even in circumstances where border closures into Canada are in effect. If your reservation arrives after June 1, 2020 or up to August 31 of 2020, we will allow you to move the reservation to a later date in 2020 in the same property or convert your deposit payments into a travel credit that can be used in any property EMR Vacation Rentals manages but it must booked within 365 days from your cancelled arrival date and must be used by December 31, 2021 stay dates. The rates are subject to seasonal dynamic rate changes. If you decide to during a high demand period versus lower demand period for example, guests will be responsible for only the rate difference and taxes on those differences. There are no refunds for unused travel credits nor are the travel credits transferable to a different guest.

Can I pick dates beyond 12 Months?

Yes based on availability of the property but the stay must be used no later than December 31, 2021. However, since each property is independently owned, future dates well into 2021 may not yet be made available by the owner of the property.

Once I’ve selected my rescheduled dates can I change the dates again?

You can only change the dates for a second time if there are local COVID-19 restrictions in place. This will be at our discretion and based on local British Columbia regulations that directly impact the property that has been rented.

What happens if I choose to cancel my booking and do not wish to have a travel credit or move my dates – what will I get back if I cancel?

The EMR Vacation Rentals standard cancellation policies in the guest agreement will apply. See section under Cancellation By Guest.

If you have booked through AirBnb, please submit a cancellation request through their website booking platform.

Isn’t there a travel ban?

Currently there is not an official travel ban in British Columbia only a advisory to ensure proper social distancing and cleaning procedures also follow all mask requirements in some businesses and public places. Canadians are not being denied entry or travel into British Columbia.

Can I have visitors over to see me at during my vacation rental stay?

This is an evolving policy please be aware it can change at any time. Besides abiding by EMR Vacation Rentals restrictions on additional guests visitors, there is currently a Provincial Health order requiring no more than 5 visitors over at one time to see you. We are requiring our guests to ensure they keep a detailed list of full names and contact information for every visitor you have had over to the property. We may need this information to provide the the BC Government in the event of an urgent need to contact trace over a positive COVID-19 finding.

I’m traveling from outside of Canada, can I cross the border?

This is dependent on each country of origin and their travel agreement with the Canadian Government. Please check current travel restrictions to Canada by contacting your local border authorities from your country of origin. Currently US travel into Canada has a non essential travel ban until November 21, 2020. 

Please note we are no longer providing refunds due to border restrictions for COVID-19 for any traveler outside of Canada. We can assist in moving your dates or providing a travel credit for a future stay. 

Important Note: Please make sure you have purchased sufficient trip cancellation and disruption insurance. Most credit card companies sell trip cancellation insurance to their cardholders or already have it included as part of their members perks. Please check with your credit card company to confirm. If they do not sell it we advise contacting Travel Guard International of Rental Guardian or any other third party travel insurance provider.

Veggie, Steady, Go! Where to Find Great Vegan and Vegetarian Food on Vancouver Island.

One of the best things about this modern world is that there are so many food options for everyone no matter what your dietary needs or preferences are. First up on our plant-based favourites list is the mindfully curated menu at Be Love. Using almost entirely organic, seasonal ingredients, everything on the menu at Be Love is made without wheat, gluten, dairy and processed sugar – which is pretty amazing considering how delicious everything is! One of the vegetarian staples in the capital city is Rebar in Bastion Square. At this long-standing, low-key vegetarian restaurant, you can find smoothies and delicious, filling, comfort food made with fresh, local ingredients. In the mood for something a little more chic? Aura offers stunning views of the Inner Harbour, great ambience, an impressive drinks list and a food menu that is hard to beat. No matter if you’re there for breakfast, lunch or dinner, Aura has mouth-watering vegetarian dishes that can be easily modified to be vegan. For the hottest vegetarian breakfasts in town, you’ll need to visit Fuego! With a huge, excellently executed Mexican and Latin American inspired menu, Fuego is a great place to go to spice up your morning. If you’re looking to stock up the fridge while you’re in town make a trip to The Market on Yates for an incredible selection of fresh, local produce, tons of meat and dairy substitutes and a huge selection of local products. If you’re looking for really exceptional meat substitutes though, you must visit the Very Good Butchers. Located in the Victoria Public Market, this ingenious ‘butcher shop’ makes flavourful, perfectly seasoned vegan sausages, burgers, taco filling, short-ribs and more.

Cowichan Valley & Parksville

Just twenty minutes north of Victoria and a five minute drive from Bayside Cottage Mill Bay, nestled in the forest, with the most astonishing views you’ll find some of the best dining on all of Vancouver Island at Alpina Restaurant. With a thoughtful, European inspired menu and plenty of vegetarian options, this is the perfect place for an unforgettable meal. A little further north, thirty minutes from Salishan Tree House Suite is a local hub downtown Duncan called The Duncan Garage Cafe & Bakery. Here you can find local, organic, vegetarian lunches, desserts and snacks that are completely in-house-made. This small, quirky, bustling little community spot is not only a great place to stop for delicious, healthy food, it also has a little market, health and vitamin store and a bookstore! If you’re staying at Salishan Tree House Suite, you’re in luck because one of the best places to stop for the freshest, local groceries and a large selection of speciality items is Great Greens Farm Market. While you’re staying with us, Lefty’s is a must for a laid-back, diner atmosphere and delicious comfort-food with lots of vegetarian options and vegan friendly modifications. For something a little more upscale, Chameleon’s is the highest rated restaurant in Parksville and offers delicious vegetarian options. If you’re looking for specialty groceries while you’re at Columbia Beach House, the best place to find them is Heaven On Earth Natural Foods. Cycle, Hike or Ski into the New Year! Winter Adventures on Vancouver Island

Happy New Year! With the holidays behind you and the new year ahead, what better time to shake off that holiday excess with some incredible winter activities on Vancouver Island? The best thing about winter on the island? We’re not known for our long white winters and that means that it is a perfect place to indulge in many outdoor adventures all year-round. Hike or cycle one of the many incredible trails that wind all across the island. For the experienced surfers, you can find excellent surfing nearby, especially in the winter. And if you are looking for a winter wonderland, you can head north to one of the top Alpine Resorts in Canada. We really do have it all. 

Vancouver Island is world renowned for its incredible, natural beauty and with so many trails all over the island, it’s easy for everyone to get out there, no matter your skill level. No matter what level of cyclist you are, you won’t be disappointed with a ride along the Galloping Goose Trail or the ‘Goose’ as locals call it. This 55 kilometer, excellently maintained, popular trail begins downtown Victoria and winds its way west through Metchosin, Sooke and then heads north to end at the top of Sea to Sea Regional Park. While you won’t be able to do the entire trail in one day, it’s so long you can quickly access this trail no matter if you’re staying at Victoria at Reef Executive Condo or Metchosin at Arbutus Hill or Sooke at Pacific Coast Beach House and Suite and experience different parts of this incredible trail. Just north of Victoria and for anyone staying at Heron’s Landing, the Lochside Trail is a picturesque, multi-use trail that stretches from the tip of the peninsula at Swartz Bay and connects to the Galloping Goose in downtown Victoria. On this trail you can experience the Saanich peninsula’s beaches, agriculture, wetlands and rural neighbourhoods. From urban to rural to wilderness, if you’re looking for a great way to experience the natural beauty of the West Coast on a bike, there’s no better way to do it than from either the Goose or Lochside. If you’d prefer to explore on two feet rather than two wheels, both the Galloping Goose and Lochside are good options as they both provide hikers with easily accessible, well maintained trails. But for those of you looking to get a little off the beaten track, there are lots of trails just north of Victoria, right nearby the Nature’s Gate Executive Home that are sure to impress.The Cowichan Valley Trans Canada Trail is a whopping 132 kilometers of well-packed gravel that is easy to ride, walk or jog along. Mostly following old CN rail lines, this section of the Trans Canada Trail winds through BC’s lush temperate rainforest that is home to some of the world’s tallest trees. You can find more information about the trail including maps and trail closures here and if you need information about the trail sections, parking and rest-stops you can find all that here. Just a 5 minute drive from the Malahat Mountain House is Spectacle Lake, a perfect fit for those looking for a more easy-going hike and for anyone who loves to fish. This trail is flat, well maintained and loops around the beautiful lake with plenty of places to stop and drop a line. If you’re looking for something a little more challenging, you’ll be hard pressed to find a better hike than the popular Cobble Hill Mountain. Just a beautiful 10 minute drive from Cowichan Bay Oceanfront Estate, Cobble HIll Mountain is made up of 26 kilometers of well maintained, signed trails ranging in difficulty so finding the right trail for you is easy. The trails will lead you through multiple ecosystems and breathtaking views of the Cowichan Valley. Come find out how the locals stay in shape! 

You don’t have to fly to Hawaii or Australia to get in some great winter surfing – although it will be a little colder! If you’re an experienced surfer and are ready to brave the icy waters, you can catch some excellent waves right here on Vancouver Island. Tofino and Uculet are surfing hotspots but you might be surprised to hear that south Vancouver Island has some killer waves too! Only 30 minutes from Pacific Coast Beach House, 45 from Station Villa Executive Condo and an hour from Arbutus Hill is Vancouver Island’s hidden surfing gem, Jordan River. This tiny little community on the edge of the Pacific Ocean offers up some incredible views and even more incredible surfing. Just a little farther north is Sombrio Beach. Sombrio has great surfing at any tide level and offers a beach and reef break, which provides more consistent waves than Jordan River. With waves that can range from 2ft to 10ft, unpredictable conditions, freezing water and Pacific Ocean currents, neither Jordan River nor Sombrio are good spots for a novice. For those of you who feel at home on the waves, keep a close eye on the surf conditions here and here and don’t forget to grab your booties, gloves and hood – you’re going to need them!  

We may not be known for our white winters but when we do get the occasional snowfall, Victorians really take advantage of it in one of the best ways – sledding! So when the snow starts to stick, Victoria is a great place for the young and young-at-heart to bundle up and head to the nearest slope. Not far from Dalmeny Farm Estate, the famous Beacon Hill Park has acres of meandering groves of oak trees, ponds, gardens, moss covered boulders and one of the top sledding hills in Victoria! What could be better than a beautiful, snowy walk through the park and an afternoon of sledding? Just a short drive from Barkley Manor Executive you’ll find the Cedar Hill Golf Course which is another very safe, easygoing, fun hill to go sledding. Because it’s a golf course, you’ll find the area excellently manicured with no hidden rocks or brambles to get stuck in, plus there’s plenty of parking to make the trip that much easier. Without snow, Mount Tolmie is known for its steep, rocky incline but with a thick blanket of snow, it’s an ideal place to go for those looking for a more thrilling sledding experience but there are some gentler options for younger ones that may go with you. If you’re staying at EMR (Oak Bay/Rockland/Uplands), the Victoria Golf Club is a great spot for a sledding adventure! Like Cedar Hill, Victoria Golf Club is a manicured slope that means it’s super safe for all ages. Afterwards, you can stroll through historic Oak Bay village and check out the local shops and grab some cocoa in a perfect wintry village. If you’re really desperate for a proper snowy adventure, don’t despair! Mt Washington Alpine Resort has everything you could want from an alpine resort, great skiing, snowboarding, snowshoeing, cross country skiing and sledding. If you’re coming from Victoria, you’re looking at a 3.5 hour drive to get there but if you’re staying at Kye Bay Winter Beach House, you’re only a 40 minutes from a winter wonderland!
